Please read these Terms & Conditions carefully before using AI FaceSwap Studio.

1. Acceptance of Terms

By accessing and using AI FaceSwap Studio (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. License and Access

AI FaceSwap Studio grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Use the Service for personal, non-commercial purposes
  • Process images using our AI tools
  • Access features according to your subscription plan

You may not:

  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for commercial purposes without written permission
  • Attempt to gain unauthorized access
  • Use automated tools to scrape or collect data
  • Transfer your account or credentials to third parties

3. User Content & Intellectual Property

3.1 Your Ownership

You retain all rights to images you upload. By uploading content, you grant AI FaceSwap Studio a worldwide, royalty-free license to:

  • Process and analyze your images
  • Store images temporarily for service delivery
  • Use anonymized, derivative data for improving our AI models

3.2 Our Intellectual Property

All content, features, and functionality of AI FaceSwap Studio are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

4. User Responsibilities

You are responsible for:

  • Legal Compliance: Ensuring your use complies with all applicable laws
  • Consent: Having necessary rights to all images you upload
  • Content: Not uploading offensive, abusive, or illegal content
  • Account Security: Protecting your device ID and account credentials
  • Prohibited Use: Not using the Service for harassment, fraud, or illegal purposes

5. Subscription & Payment

5.1 Plans

We offer Free and Premium subscription plans with different features and limits. Detailed plan information is available in-app.

5.2 Billing

Premium subscriptions renew automatically based on your billing cycle. You will receive payment reminders before renewal.

5.3 Cancellation

You can cancel your subscription at any time through your account settings. No refunds are provided for partial months.

5.4 Credits

Features consume credits based on complexity. Unused credits do not carry over to the next billing cycle. Credits are non-refundable.

6. Prohibited Content

You agree not to upload, process, or share content that:

  • Violates privacy or rights of third parties
  • Contains hate speech, discrimination, or harassment
  • Is sexually explicit or exploits minors
  • Involves illegal activities or fraud
  • Contains malware or harmful code
  • Infringes intellectual property rights
  • Is used for deepfakes to deceive or harm others

7. Limitation of Liability

To the maximum extent permitted by law:

  • AI FaceSwap Studio is provided "AS IS" without warranties
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the last 12 months
  • We are not responsible for loss or corruption of data

8. Indemnification

You agree to indemnify and hold harmless AI FaceSwap Studio from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of third-party rights.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

We make no representations or warranties, whether express or implied, including:

  • Merchantability or fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free service
  • Security of data transmission

10. Service Modifications

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change features, pricing, or plans
  • Remove or restrict access to features
  • Suspend service for maintenance or security reasons

We will attempt to provide reasonable notice of significant changes.

11. Account Termination

We may terminate your account if you:

  • Violate these Terms & Conditions
  • Engage in illegal activities
  • Harass or abuse our support team
  • Attempt to hack or exploit the Service
  • Are inactive for 12+ months

Upon termination, your account and data will be deleted within 30 days.

12. Third-Party Services

AI FaceSwap Studio integrates with third-party services (AIPhotoCraft, WaveSpeed). Your use of these services is subject to their respective terms. We are not responsible for their actions or content.

13. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by applicable laws of India.

Dispute Resolution: Any disputes shall be resolved through binding arbitration or litigation in appropriate courts.

No Class Actions: You agree not to participate in class action suits against AI FaceSwap Studio.

14. Data Storage & Image Expiration

⚠️7-Day Retention Policy: All processed images and outputs are automatically deleted from our servers after 7 days. Users must download and save all images before expiration.

  • Automatic Deletion: Images are permanently removed after 7 days without notice
  • No Recovery: Deleted images cannot be recovered
  • User Responsibility: You are responsible for downloading and backing up your images
  • No Liability: AI FaceSwap Studio is not liable for loss of images due to expiration

15. Right to Update Pricing & Features

AI FaceSwap Studio reserves the right to:

  • Update Pricing: Change the cost of features at any time without prior notice. Updated feature costs will apply to all credit purchases, both past and future, regardless of when the credits were purchased or how much credit is available.
  • Modify Features: Add, remove, or modify features and functionality at our discretion
  • Improve Service: Make updates for better functionality, security, or user experience
  • Discontinue Services: Discontinue any feature or service with reasonable notice

Changes will be communicated through in-app notifications or email. Your continued use indicates acceptance of these changes.

16. Right to Update Terms & Privacy Policy

We reserve the right to update these Terms & Conditions, Privacy Policy, and any other policies at any time at our convenience. We will provide notice of significant changes through:

  • In-app notifications
  • Email notifications
  • Updates to this page (date updated at top)

Your continued use of AI FaceSwap Studio after any updates constitutes your acceptance of the changes. If you disagree with any changes, you may discontinue use of the Service.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Changes to Terms

We may update these Terms at any time. Significant changes will be notified via email or in-app notification. Your continued use indicates acceptance of updated Terms.
